The Festival Marks

SOBEWFF LockupThe Festival marks include, but are not limited to, trademarks, service marks, names, and logos owned by SWS Holdings, Inc. and used here by permission, as well as any work, slogan, image, or other designation that identifies the source or origin of any of the Festival’s goods and/or services. This can include both word marks that contain only text (i.e. Burger Bash®) or in a design format, such as the Burger Bash® logo.

SWS Holdings, Inc. maintains federal, state, and/or common law trademark protection in and to these marks in the United States.

What uses of Festival marks are prohibited?

  1. Unapproved Events
    As the Festival has grown, so too have other culinary events taking place throughout the country, and in Miami-Dade and Broward counties in Florida during the month of February. To eliminate confusion, only official SOBEWFF® events are permitted to use Festival marks. Accordingly, use of the Festival marks, or any confusingly similar variations thereof, in association with the promotion or operation of an event that has not been explicitly approved or sanctioned by the Festival in advance is strictly prohibited.
  2. Disparaging Uses or Violating Laws
    Use of the Festival marks in a disparaging manner or in a way that violates any law or regulation is strictly prohibited.
  3. Wrongful Assertions of Ownership/Relationship
    Any display of the Festival marks that suggests or implies that you own or control the Festival marks is strictly prohibited. Additionally, any display of the Festival marks that suggests you have a sanctioned relationship with the Festival that does not exist is strictly prohibited.

Editorial Content
We encourage you to discuss the Festival and its events in editorial content, and we enjoy hearing about your official participation and experiences at the Festival. Editorial content includes reviews, news reporting, and social commentary that expresses opinions about the Festival or provides objective reporting about the Festival and its events. Such editorial content is probably acceptable without a license, but be aware that editorial content that suggests that the Festival approves of the content and commercial content requires a license, and the Festival reserves the right to request your removal of such content.

What uses of the Festival marks require a license?

The non-exhaustive list below identifies ways in which you may wish to use the Festival Marks. Each of these uses requires a license, which may be requested by emailing [email protected]. The Festival reserves the right to approve or deny any license request at its sole discretion.

  1. Commercial Use
    “Commercial use” of the Festival marks without advance written approval from the Festival is strictly prohibited. A commercial use of the Festival marks is any use in association with the promotion of the products or services of a person or entity other than the Festival.
  2. Merchandise
    You may not use the Festival marks on any apparel, posters, toys, bags, promotional items, or other merchandise without a written license agreement from the Festival.
  3. Contests & Giveaways
    You may not use the Festival marks in connection with any raffles, giveaways, auctions, contests, sweepstakes, competitions, or similar activities without writer permission from the Festival.
  4. Digital Use
    Use of the Festival marks on the internet is typically a commercial use (see above). The Festival marks shall not be used in any web URLs without the Festival’s prior written approval.

How should the licensed Festival marks be displayed?

The non-exhaustive list below identifies ways in which you may wish to use the Festival Marks. Each of these uses requires a license, which may be requested by emailing [email protected]. The Festival reserves the right to approve or deny any license request at its sole discretion.

  1. Request Approval
    All proposed displays of Festival marks must be submitted to the Festival for prior approval. Such approval may be done via email.
  2. Include Trademark Notice
    The Festival requires consistent use of the Festival marks and the registration symbol (“®”), or – if applicable – the trademark symbol (“™”), alongside the licensed Festival marks the first time the Festival marks appear in the text of an approved use. Please refer to the non-exhaustive list of Festival marks to determine whether it is appropriate to use the registration symbol or trademark symbol in association with certain Festival marks. Please note that listing of certain Festival marks inclusive of annual corporate partners (i.e. Food Network & Cooking Channel South Beach Wine & Food Festival) may not require use of the registration or trademark symbols.
  3. Comply With Logo Guidelines
    Upon licensing of the Festival marks, approved high-resolution versions of the art comprising certain Festival marks (“logo”) and the corresponding guidelines (“logo guidelines”) can be accessed here. Any licensee that is issued a trademark license for a logo will be required to follow the logo guidelines.
  4. No Modification of The Festival Marks
    Any approved use of the Festival marks must be displayed exactly as written (in the case of a word mark) or depicted (in the case of a logo). No exceptions.

The absence of a trademark, name, logo, slogan, image, or other designation from this list does not constitute a waiver of SWS Holdings, Inc.’s intellectual property and/or trademark rights in such trademark, name, logo, slogan, image, or other designation.
